Introduction

"Calday" is legally owned and operated by Hefei Xiguoke Network Technology Co., Ltd. and/or its affiliated companies (hereinafter referred to as "Xiguoke" or "We"), including the Calday mobile note-taking software. Calday services and various business functions are collectively referred to as "Our Products and/or Services."

This Agreement is a contract entered into between the user and us regarding the products and/or services. Please read it carefully before using. By agreeing to this Agreement or completing registration/login, you indicate your acceptance of the Agreement's content; if you disagree, please do not proceed with subsequent operations, otherwise, you will be deemed to have accepted the terms of the Agreement.

1. For Personal Use Only

Calday is for users' personal, non-commercial use only. Selling Calday or related materials, services, or software requires permission from Xiguoke. Users may provide comments and suggestions for improvement.

2. Intellectual Property

Users acknowledge that Xiguoke owns all rights to Calday, including intellectual property rights (covering rights and applications, updates, etc., under patent law, copyright law, etc.). Users shall not modify, adapt, translate Calday, create derivative works, obtain source code through decompilation, etc., nor delete, obscure, or alter copyright notices, trademarks, or proprietary statements.

3. User Responsibilities

3.1 Software Usage Guidelines

Users are responsible for their use of the software and services. Without authorization or permission, the following actions are prohibited:

1. Using unauthorized plugins, external tools, or other means to interfere with, damage, or modify the normal operation of the software and services.
2. Engaging in activities that endanger computer network security by utilizing or targeting the software and services, such as illegally intruding into networks, providing programs or tools that endanger network security, assisting others in endangering network security, using data or accessing servers/accounts without permission, damaging network security, interfering with or destroying system or website operation, forging data packet names, reverse engineering, etc.
3. Maliciously registering accounts.
4. Other acts that violate laws and regulations, this Agreement, company rules, or infringe upon the legitimate rights and interests of others. Xiguoke has the right to judge and handle such situations, and may terminate services and pursue legal liabilities.

3.2 Content Behavior Guidelines

When using Calday, you must comply with national laws and regulations and must not send or disseminate illegal, non-compliant, or uncivilized information. Otherwise, we may delete or block such information and, depending on the circumstances, take measures such as warnings, limited-time corrections, or suspension of services. Such information includes:

1. Opposing the basic principles of the Constitution.
2. Endangering national security, leaking state secrets, etc.
3. Inciting ethnic hatred, discrimination, and undermining national unity.
4. Undermining national religious policies, promoting cults and feudal superstitions.
5. Spreading rumors, disturbing social order.
6. Spreading obscene, pornographic, or other illegal content.
7. Intimidating, insulting, attacking, or defaming others.
8. Using the platform to engage in illegal and criminal activities.
9. Publishing content that infringes upon others' intellectual property rights and legitimate rights.
10. Infringing upon the rights and interests of minors or harming their physical and mental health.
11. Spreading commercial advertisements, excessive marketing, and spam.
12. Containing other illegal, non-compliant, disruptive to normal operation, or infringing content.

3.3 Data Storage Guidelines

1. Calday provides storage services, and users retain intellectual property rights to their content. Without permission, Calday shall not copy, share, or transmit user files to third parties.
2. When users upload, submit, or save content to the server or download content, they authorize Calday to host and save the files, and to access and delete uploaded content. Users must ensure that they have the necessary permissions for the submitted content.
3. Uploaded, submitted, or saved content must be legal. Otherwise, Calday has the right to delete illegal files, revoke access and editing permissions, or take other actions.
4. Multiple people are prohibited from sharing one Calday account. Do not disclose or share your account with others, otherwise, you will be solely responsible for file loss or alteration.

4. User Privacy Policy

Xiguoke generally does not disclose, edit, or reveal user registration information or non-public content, except in the following necessary circumstances:

1. To comply with legal provisions and inquiries from relevant state authorities.
2. To maintain Calday's trademarks and other intellectual property rights.
3. In emergency situations, to protect the privacy and safety of users and the general public.
4. Other circumstances deemed necessary by Xiguoke.

5. Service Changes

Xiguoke reserves the right to change, interrupt, or terminate services at any time without prior notice to users, and shall not be liable to users or third parties.

6. Limitation of Liability

Users voluntarily choose to download and use Calday and third-party software at their own risk, and bear full responsibility for damage to computer systems or data loss. To the maximum extent permitted by law, Xiguoke provides no express or implied warranties, such as merchantability, fitness for a particular purpose, etc.

Xiguoke and its licensors make no representations or warranties that:

1. Your use of the services will meet your requirements.
2. Your use of the services will be uninterrupted, timely, secure, or error-free.
3. Any information obtained by you as a result of your use of the services will be accurate or reliable.
4. Defects in the operation or functionality of any software provided to you as part of the services will be corrected.

Xiguoke shall not be liable for any accidental, indirect, special, or consequential damages or claims arising from your use of Calday. Uploading content implies authorizing Xiguoke to save the content on its servers. Users or original copyright holders still retain copyright, and Xiguoke shall not publish the content on other public channels without permission. Using other services from Xiguoke or its affiliated companies requires compliance with their respective terms of service.

7. Indemnity

Users agree to indemnify and hold harmless Xiguoke, and are responsible for paying attorney fees, damages, government penalties, and other infringement compensation incurred due to violation of the service terms.

8. Third-Party Products and Services

1. This software may use third-party software or technologies that have been legitimately authorized.
2. If third-party software or technologies are used, relevant agreements or documents may be presented through attachments to this Agreement, specific folders in the installation package, etc., and have the same legal effect as this Agreement. Users should comply with them. Failure to comply may lead to legal issues, for which users shall bear sole responsibility.
3. Disputes arising from third-party software or technologies shall be resolved by the third party, and we shall not bear responsibility or provide customer support. Users need to contact the third party.

9. Law and Agreement Updates

1. We have the right to modify the terms of the agreement based on changes in national laws and regulations and the operational needs of the website, and to make them public. The modified agreement will become effective upon its publication. Users should pay attention to the latest agreements and announcements. If you do not agree to the updated agreement, you have the right to stop using the products and/or services; continued use will be deemed as agreement to the updated agreement.
2. This Agreement is governed by and construed in accordance with the laws of the People's Republic of China. In case of disputes, they shall be submitted to the local people's court for jurisdiction.
